While this is true is some cases, it is important to make sure that an infant with jaundice receives proper medical treatment. Without it, jaundice can cause a number of serious medical issues for an infant.
If your baby developed jaundice and suffered a birth injury due to complications, you may have a birth injury case. At Willens Law Offices, our team of experienced birth injury attorneys will help you understand your legal rights and options.
It is not abnormal for a baby to be born with a yellow tint to their skin. In fact, as many as 80% of full-term babies develop jaundice within the first or second week of life. Jaundice develops when there are high levels of bilirubin in the blood.
Everyone has bilirubin in their blood, it is a byproduct that is made from red blood cells when they break down. It is the liver's job to remove bilirubin from the blood and then the body gets rid of it through bowel movements.
When a baby is in the womb, the mother's liver takes over the job of removing the bilirubin from her baby's blood. Once born, it can take a while for the baby's liver to start doing the job. When this happens, there can be a build up in the baby's blood and this causes jaundice.
However, when bilirubin levels become too high for too long, jaundice can cause birth injuries.
When a newborn develops jaundice, typically within 2 to 4 days after being born, it is important to keep an eye on it. If the level gets too high, a baby may develop hyperbilirubemia, a serious condition that can lead to Kernicterus.
Kernicterus is a type of brain damage that is caused by excessive jaundice. This occurs when the level of bilirubin gets so high that it moves out of the blood and into the brain tissue. When this happens, a baby will become very lethargic. They will be very sleepy and will be difficult to arouse. As the damage continues, a baby will likely develop a decrease in muscle tone and may arch their head and their back backwards. The condition may lead to fever and seizures.
If Kernicterus is not detected and/or treated immediately, a baby may suffer serious brain damage. A physician should have the proper experience and knowledge to be able to detect such a serious problem. There is really no reason why a baby with jaundice should get into such a serious condition. However, there are some risk factors that contribute to a baby developing high levels of bilirubin in their bloodstream. Some of these include:
Jaundice may get worse in a baby that has other medical complications such as an infection, congenital diseases, other genetic disorders, and hypoxia.
If your baby has suffered a birth injury due to complications with jaundice, you may be coping with the emotional and financial costs of such a devastating situation. Receiving compensation for medical expenses, pain and suffering, disability, and emotional stress are all damages you are entitled restitution for.

The plaintiff went to a Chicago hospital for delivery of twins via cesarean section. In the delivery room, a suspicious rash was recognized on one of the twins and later, fecal and urine cultures confirmed the presence of candida. She was started on prophylactic anti-fungal medicine and is healthy. The other twin was clear of any rash and though she was at risk for fungal infection, she was not treated in a timely manner. Later, a head ultrasound and MRI confirmed the diagnosis and damage to her brain. A lawsuit was filed on the plaintiff’s behalf. The case was vigorously defended by lawyers for the physician and the hospital that he worked for over 3 years. Eventually, a mediation took place at which time the defendants offered $3,000,000 to settle, which the plaintiff rejected. It was not until trial that the case settled for $10,000,000.
