Forceps Birth Trauma

For decades, birth-assisting tools such as forceps have been used to help in difficult deliveries. When they are used correctly, they can be beneficial. However, there have been a large number of birth trauma associated with the use of forceps, and this is cause for concern. Even though the risk of harm to a baby is high when using forceps, doctors continue to use them.

If your baby was injured at birth due to the use of forceps, contact Willens Law Offices to discuss your legal rights and options. Our attorneys are experienced with many types of birth injuries. If a healthcare provider has caused damage to your child, they should be held accountable.

What are Forceps and How are they Used?

Basically, forceps are similar to a large pair of of tongs. They are used to assist in the vaginal delivery of a baby. Some reasons for needed assistance may be if the mother is exhausted and can no longer push, in the case of a maternal hemorrhage, if a baby's heart rate suddenly drops, or if labor just isn't progressing.

When a baby is in the birth canal, the forceps are applied to the baby's head to help guide it out. This is generally done during a contraction, in combination with the mother pushing. They may be used when labor isn't progressing but the baby is in the birth canal. If the use of forceps is unsuccessful, a C-section delivery is typically needed.

The Risk of Using Forceps

It is important that a doctor place the forceps correctly around a baby's head and to not use excessive force. Additionally, a physician must have informed consent. While doctors generally acknowledge that there is a risk associated with the use of forceps, they are still used by some. The risk to the mother due to using forceps include:

In addition to the risk to the mother, there are several risks associated with the use of forceps for the baby. Some of these include:

When a baby or mother is injured by the use of forceps, the symptoms are generally noticeable. There will be cuts, bruising, or bleeding to the injured area. A forceps injury can often lead to other birth complications. Some of these include hypoxic ischemic encephalopathy (HIE) and cerebral palsy. As a result a forceps injury should not be taken lightly.

$10,000,000 Chicago Birth Injury Settlement

The plaintiff went to a Chicago hospital for delivery of twins via cesarean section. In the delivery room, a suspicious rash was recognized on one of the twins and later, fecal and urine cultures confirmed the presence of candida. She was started on prophylactic anti-fungal medicine and is healthy. The other twin was clear of any rash and though she was at risk for fungal infection, she was not treated in a timely manner. Later, a head ultrasound and MRI confirmed the diagnosis and damage to her brain. A lawsuit was filed on the plaintiff’s behalf. The case was vigorously defended by lawyers for the physician and the hospital that he worked for over 3 years. Eventually, a mediation took place at which time the defendants offered $3,000,000 to settle, which the plaintiff rejected. It was not until trial that the case settled for $10,000,000.
